THE PROBLEM WITH CINDRU: "ANY INTERESTED PARTY CAN SUE TO HAVE THEM (RECORDS) OPENED"

Tonight ABC News will feature a segment on records access. As a run-up to the show a discussion about adoptee rights is being held on the ABC internet forum. The direct link isn’t punching in, so cut and paste this http://abcnews.go.com/WN/comments?type=story&id=4332269 Everyone so far supports adoptees except one poster: As an adoptive parent who chose to adopt internationally under the UN’s Hague Treaty, I can tell you it is better to do so internationally than to adopt domestically. There is no uniformity to adoption laws in the US and they definetly are NOT written with the interests of the adopting parents in mind. These people are the most important part of a successful adoption yet they have very little legal standing during the adoption process. We wanted a truly closed adoption. In the United States, there is no such thing. No matter how much records are supposedly sealed. Any interested party can sue to have them opened. We wanted none of that.Posted by:Cindru2000 Feb-23 I’m sure that Bastardette’s readers–or adoptee rights activists and adoptees in search–will be comforted to know that “any interested party” can sue to have records opened. Technically, of course, anybody can sue, but I guess all Continue Reading →

NEBRASKA”S NEW BABY DUMP LAW: BETTER THAN RITILAN

In case you missed it, Alaska and Nebraska finally went over to the dark side and legalized baby dumping recently. But in the case of the Nebraska law, it’s fast-track child dumping. Child welfare workers and juvenile court judges are gonna love working with this one! The law, outside of a two sentence intro, reads in full: Section 1. No person shall be prosecuted for any crime based solely upon the act of leaving a child in the custody of an employee on duty at a hospital licensed by the State of Nebraska. The hospital shall promptly contact appropriate authorities to take custody of the child. Note that any CHILD can be left at a hospital. No age limit. In other words, the Nebraska legislature just legalized child abandonment as long as it’s done “properly.” Wanna test-drive your kid? Move to Nebraska! Terrible 2s? No problemo! How about that mouthy 13-year old son? Cheaper than Ritalin. LB157 is the late Dr. Pierce’s fantasy of flexibility” of choice, “non-bureaucratic placement” and safe havens at any age.* Appropriately, Nebraska is Dr. Pierce’s home state. Lately, he’s been thunking his shoe in heaven (think Maine!) , but I heard a little chortle, too. Continue Reading →

MAINE: SEN. PAULA BENOIT ON NATIONAL TV THIS WEEK!

Yay! The Kennebec Journal * reports that Maine Senator Paula Benoit will appear on the Charlie Gibson Show on ABC this week to discuss records access and the victory in Maine! Bastardette has met Sen. Benoit a couple times and she is one class act! Here’s quote from the article: “The fact that in trying to find my identity Idiscovered that two of my legislative colleagues weremy nephews is a great story, but it is also importantto remember that while the story is great, what ismost important is that because of this law thousandsof adult adoptees will be able to have access to theiroriginal identity in 2009,” she said in a statement. The segment is expected to air Wednesday, Thursday orFriday at 6:30 p.m. on ABC. Benoit’s district includesRichmond, and 10 other Sagadahoc County communities, along with Dresden in Lincoln County. *NOTE: For some reason the link isn’t working, though it was cut and pasted in. ME AND MRS. DAIGLE

I don’t remember the first time I saw the film The Bad Seed. Based on the 1954 William March bestseller and adapted for the stage by Maxwell Anderson, The Bad Seed had a profound effect on me as a child. By the age of 8, although I hadn’t articulated, it, I’d already determined that children are inherently evil, parents inherently stupid, and suburbia inherently fake. The film validated my deepest thoughts. Making it personal, Patty McCormick, who plays little killer Rhoda Penmark to near perfection, had been a favorite of mine in an edgy sort of way, when she played Ingeborg on the TV show I Remember Mama. I experienced a peculiar “ownership” of her when my doppelganger brat made it big in The Bad Seed on Broadway and then Hollywood. Oddly, Ingeborg and Rhoda were interchangeable with their long hard starched braids. Except for Ingeborg’s 1917 wardrobe, they were identical. Fast forward 30 years. I’m working at the Ohio State University Department of Theatre. Our alumni includes Eileen Heckart, the actress who created the role on Broadway and carried it to film, of Mrs. Daigle, the mother of hapless Claude Daigle, shoved in the lake and drowned by Rhoda Continue Reading →

ILLINOIS: WARNING! TRAINWRECK AHEAD FOR RECORDS RIGHTS

Today Anita Field, founder of Illinois Open sent a letter to Illinois adoptee rights activists updating them on the “open records” situation in that state–the new bill that’s supposed to liberate all of their OBCs from the file cabinets of oblivion. The news is not good. Below are my comments followed by Anita’s letter. On November 19, 2007 the Chicago Sun-Times reported that Illinois State Representative Sara Feigenholtz (D-12) intended to file legislation that would make available to all Illinois adoptees, their original birth certificates. Bastard Nation collectively rolled its eyes and waited. Some BN members had experienced Ms Feigenholtz’s “devotion” to access in the mid-1990s, when she abandoned them and a clean records bill to a seriously dysfunctional registry scheme that treats adult adoptees like 7 year olds. Due to her new press-reported putative interest in adoptee rights, Ms. Feigenholz was invited to attend the December 2007 Donaldson roundtable in New York City. Like some other interested parties, she was unable to attend in person so she and her “assistant” Melisha Mitchell sat in by phone. Mitchell is the proprietor of The White Oak Foundation, a professional CI service (Mitchell pays herself $65k a year–Guidestar) that passes itself off Continue Reading →

MISSOURI: WHO IS CAROLYN POOLER AND WHY IS SHE SAYING TERRIBLE TIHNGS TO REP. JOHNSON?

AdoptionLand is abuzz with the news that Rep. Connie “LaJoyce” Johnson, sponsor of Missouri records access bill, HB 1998, has pulled the plug after a woman named Carolyn Pooler got into it with her over something in it, but we don’t know what. Pooler’s objection could be this section of the proposal in which a contact veto is disguised as a “contact preference,” a restriction Bastard Nation and Bastardette vigorously oppose. ROGUES GALLERY: A HANDY GUIDE TO ADOPTION CORRUPTION AMERICAN STYLE

RUN, DON’T WALK RIGHT NOW! Jamie Marsh has just blown the door off the whole JCICS/NCFA/FOA outhouse with his new blog Focus on Adoption: A Rogues Gallery. If you’re looking for a handy guide to adoption corruption that even boggles my mind, this is it. The war is on! There are a few new names here for me, so I know many of you won’t be familiar with all the players either. But don’t let that hold you back. There is much to read, re-read and re-re-read , digest, and read some more (including plenty of links and documentation): mendacity, incestuous agency and personnel relationships, RICO, corruption, lies. It’s better than Days of Our Lives. If ever there is reason to gut Adoption American Style, this is it. After reading Rogues Gallery you’ll never have to wonder again why they want records sealed. Mr. DiFilipo, Mr Atwood and the gang at Focus on Adoption are gonna wake up Friday morning with Headache Number 2008. And no amount of Excedrin will blot it out. I wonder how they’ll to spin it.

A SMALL MEASURE OF ACCIDENTAL (?) JUSTICE FOR MASHA

According to Masha Allen’s last counsel of record, James Marsh, ChildPromise, formerly known as Reaching Out Thru International Adoption (ROTIA), the agency most responsible for placing Masha with pedophile predator Matthew Mancuso has gone out of business. No reason given. (ChildLaw, Cambria County Casualty. Also see Marsh’s related blog, Children for Sale–Guatemala Pedo-Paradise) As Marsh reminds us, none but Mancuso have been brought to justice, legally or morally–or even received a slap on the snout, for their parts in Masha’s tragedy. Jeannene Smith, coordinator of Masha’s adoption at ROTIA, which was not licensed to operate in New Jersey at the time of the adoption, has walked away clean as the Virgin Mary, despite attempting to “mislead” the FBI and the US Congress about her role in the placement and lying to New Jersey officials and destroying documents during that state’s investigation. So brazen is Smith, now treasurer of the self-created international adoption lobby, Focus on Adoption, that last October she waltzed right in to the Adoption Ethics and Accountability Conference Future of Guatemalan Adoptions panel Q&A to advocate “concurrent planning” (local/domestic and international placement) without worrying about “cultural barriers,” to get children “released as quickly as possible.” Translation: keep the Continue Reading →

CENSORSHIP: FOREST OR TREES?

It does not take an English major, computer genius–or a “WARNING: SATIRE AHEAD” banner to figure out that Medical Adoptions is satire. The alarmed didn’t even need to go to Snopes to assuage their greatest fears. All that was necessary before hitting the hissy switch was to go to the very bottom of the Medical Adoption web page and read the following:please visit our sponsors: Conjugal Marriage | Celebrity Adoptions | Really Useful Sites Directory Of course, there will always be those who believe there really are companies that set up conjugal dates for convicts, that the Catholic Church has established a “Victims of Children Fund” or that corpse compacting is the new environment-friendly funeral option. If people will believe ManBeef, they’ll believe anything. Just because something could be true doesn’t make it true. Just ask Jonathan Swift. Obviously, everyone has a right to be disgusted and to voice that disgust. But when you ratchet up that disgust to demand that a webpage be shut down or a person or organization be shut up by government force because you don’t like what they say or do it’s another story. If anyone should understand the consequences of censorship it should be Continue Reading →
