FOREVER FAMILY – FOREVER DEAD UPDATE: KIMBERLY EMELYANTSEV PLEADS GUILTY

On June 20 Kimberly Emelyantsev, 33, pled guilty to a lowered charge of 2nd degree felony child abuse homicide in the death of her newly adopted Russian son, 14- month old Kolya. Emelyantsev initially told police Kolya fell off a chair, but later admitted that she’d dropped him on the floor–several times–causing his death by blunt force trauma to the head. (skull fracture).

Tooele (Utah) Deputy County Attorney Gary Searle said the amended charges were part of a plea bargain.

“It wasn’t an accident, but the intent to kill the child wasn’t there either.” He promised that details of the case will come out during the sentencing hearing scheduled for August 15.

Charges of child abuse against Emelyantsev and her Russian national husband Fyodor in connection with their 4-year old adopted son Luka were dropped after authorities and the county attorney’s office were unable to find enough evidence to prosecute. Fydor, held on bond since his arrest in April, will be released. Luka, and Kimberley’s biological children may be returned to the couple later. Luka, like Kolya, has Down Syndrome.

Bailiff Frank Scharmann directs Kimberly Emelyantsev into 3rd District Court Friday. Emelyantsev pled guilty to second-degree felony child abuse homicide in the death of her 14-month-old adopted son.

UPDATE: The June 23 edition of the Salt Lake City Tribune published a similar report but with the following addition:

“The woman dropped the child on March 6 “out of pure frustration,” Searle said, who added that the child was “fussy,” and “a lot of things were gon on in home involving the child and the family.”

    wtf is this and this person will go on with her life, while, the adopted child is DEAD!

    Plea bargain for a death…of a child…she probably will approved for another victim in the future after all she didn’t mean to KILL the baby she adopted..these kids are defenseless and victims…of these serial adopters…

    Finally, the revelation that they put their panties on, one leg at a time, just like we do. Moreover,they can and do become mentally ill, get divorced, abuse substances and, yes, abuse and kill the children they adopt.

    I can’t believe they let her plea bargain. That child is still dead and he has no one to plea for him.

    She will never know the truth that the person that said she would care and love him killed him.

    A better life I think not..and it is being proved again and again in U.S. just because one is adopted doesn’t mean its a better life!!!

    If this baby would have been left in Russia it probably would have been alive…not

    MURDERED…and then MURDERER getting to plea bargain!!!

    Bet that will put her at the top of the list when it comes to adopting again, as she has had a loss…no matter if it was her doing she deserves another chance as she is an entitled American married to a Russian so much more qualified than a mother who needed a little help to keep her baby..

  4. Actually, the Russian press has covered this case, as they have other cases, so Kolya’s mother should know what happened. If you read my earlier piece on the case, Kolya was voluntarily relinquished due to his Down Syndrome in the hope of treatment (forget about treatment in Russia!) and of a better life in the US. His mother and perhaps his father, too, visited him weekly until his departure to the US and had hoped to remain in contact with the Emelyantsevs. I would not be surprised if orphanage officials have been in contact with her.

    LDS was involved in the placement in some way, and I’m wondering if that isn’t how the the plea deal came down. This is Utah, ya know!

    Utah,,yep you can bet on it as far as them wanting a plea bargain for the sake of adoption in that state. Big business baby buying state of Utah.

    My dil’s sister just got arrested in Russia for visiting her sister and NOT telling police she was visiting her. She is a U.S. citizen and wanted to kiss the ground of U.S. when she got home..

    Marley you still going to retire or go to Russia to live??

    As far as the better life..what a tragic end to a precious life. Because Russia like U.S. can’t help its mothers care for there babies!

I think this not only speaks volumes about adopters and what they do to “their” children (I bought you, I can do what ever I want..that was/is my Amother’s attitude) but this pathetic story also screams volumes about children with down syndrome as well-I was the type to go up against the high and mighty jocks as they tortured the “slow” kids at their lockers in high school but alot of people abuse the retarded, especially those that work with them. Maybe this skank bitch thought this beautiful infant wouldn’t notice if he got dropped on his head, you know being so dumb and all..America is NOT any better than any other coutry, nor more evolved when it comes to compassion to those with handicaps. Personally I think she should get the death penalty for this, but since the charge has been reduced, I think life in prison is only fair. along with being legally froced to write an apology letter to the baby’s real parents and the country of Russia.

    I agree but she will be out of jail with the plea bargain as her ticket.

    With time served she may already be eligible to get probation. She probably won’t even have to serve probation..

    as I am sure she has learned that she can’t do that to a baby…

    wtf did she think would happen to the baby after treating it that way.

    Mental tests should be a requirement of all those that want to adopt.

    I am totally against adoption..but if they are going to create these forever families there needs to be some background tests and mental capacity tests on these pieces of crap adopters.

    Just because one wants a baby doesn’t mean they should get one..and thats what adoption is its all about adopters and how they can get a baby because they are entitled.

  8. Ah, Utah…the home of the biggest cult in the US which is the founder of the “bonding ceremony” and should be blown off the map. The “Moral Majority” has nothing on the LDS when it comes to mixing church and state. The power of these people is scary!

    I hurt for this poor baby’s parents. After they did what they thought would be the best thing for their child, to be told their child’s “savior” murdered him must be more than devastating.

    One of my best friends at the “Y” is a champion swimmer…4 medals from the Special Olympics. I see what happens when a Down’s Syndrome child is raised with love and care everytime I see her face. This is what those Russian parents wanted for their son. Of course, K was raised by her natural parents. She’s able, frisky, a bit spoiled but full of sunshine and has an “I can do it” attitude.

    I find it sad that there is little help for the child born with Down’s in Russia.

    My beef is the fact the agency – an affiliate of Adoption Ark – allowed this couple to adopt TWO special needs children at the same time (well – wait – the two boys were brought home over a two month period).

    IMO the family wanted to have a CHEAP Russian adoption by adopting the two S/N boys. You know, they do give you a discount if you adopt S/N kids.

    The family had biological children – didn’t one also have DS? Either way did they have ANY idea how difficult it can be to raise S/N kids? ANY? Esp two at the same time – from an institutional setting?

    The Adoption Ark affilate isn’t an LDS organization TMK. HOWEVER – their HOME STUDY agency more than likely wasn’t. Let’s put some blame on the yet unnamed Utah Home Study agency here. THEY approved the couple to adopt two S/N kids.

    Maybe that’s why she pled guilty. I noticed the Home Study agency’s name hasn’t been revealed.

  11. Well, I don’t work in the law/court field yts, but I think it is a screwed up as adoption if she gets to make any kind of “deal”. Why the hell should she get any kind of break on this? She killed an innocent baby, she admitted it so she should be in jail for the rest of her life. Is she getting to make a plea bargin because she is an Adoptive Mother? Christ, they think money can buy anything don’t they? Whoops, I dropped this annoying baby on it’s head, can I buy another one, because you don’t have a cash refund policy… Gee, I am surprised they DON’T have one, with all their bullshit about buying the “baby of your dreams” and the “perfect baby for you”.(surprised their PR campaigns don’t and for your lifestyle too..) That of course puts pressure on adoptees to like someone we might just hate if we met them on the street-If I hadn’t been so unfortunate to have been adopted by the hag I was adopted by I would of RUN like a bat out of hell if I saw her coming..if baby shaking is illegal as it should be, dropping an infant on his head should be as well. I guess people in this pompous ass of a country are never going to learn ANYTHING from Titanic-that some people should be treated better than others, because of buying power and net worth.   14. Hopefully, those who want to adopt will be put through more rigorous screening by accredited and licensed agencies. Also, the birth family here shouldn’t be let off the hook so easily either. They need to know before they decide to relinquish that there no guarantees that their child will receive a better life with a new family. I am not blaming them for this child’s murder or anything like that. Hard lesson for them to have to learn their placed baby would be still alive if they had not signed the relinquishment papers. The afamily is to blame,of course, but so is everybody else who keeps perpetuating the myths and lies that adoption is a win-win for everybody. It’s a crap shoot, just as any other kind of parenting. It’s time that birth families start educating themselves to the realities of it all.

  15. As I have been saying for the last fourteen years, people who wish to adopt should have to pass a battery of psychological tests to screen out the ones at risk for abusing/killing defenseless children.

To add…What I am reading from the many cases of ‘MURDER’involving so many Eastern European and Russian children, is the downright non-caring about these murdered internationally adopted children. “As if”..O! Well, just another foreign adopted baby, no big deal”, by the judges and courts, by the comfy sentences handed down to so many of these adoptor people. Basically telling them, Is OK we understand, it wasn’t your fault, you were overwhelmed, those foreign kids are so difficult to handle”,etc. Honestly I think the way these murder cases of adopted children are handled seems comparable to the fines for abusing and/or killing dogs! No biggie! Really makes you wonder just how much America, in it’s heart of hearts, still hates/discriminates against foreigners and/or hates children, period. Children only being worth how much they sell for and their entertainment value.

    Does anyone know… Those who adopt special needs children from other countries…do the adoptors get ‘special assistance’i.e. cash, Medicaid, etc.from our state governments, even for adopting a special needs child from another country??

    Couldn’t agree more that the families of origin of these kids need to understand that “there no guarantees that their child will receive a better life with a new family.”

    It should be a standard operating procedure to make this crystal clear to any family of origin, domestic or otherwise, as part of “informed consent.”

    I know in my case, the possibility that it might be a “crap shoot” (great term btw; ITA) was never raised.

  21. In this case, Kolya was a Russian baby with Down Syndrome. He was adopted from the Moscow Oblast which could mean anything from Moscow City to high rise Kruschev town, or some miserable village in the hinterlands.

    Russia is not a welfare state like the US and offers little assistance to anybody, especially women and children. (You do not want to get sick in Russia and end up in a free state hospital! I visited somebody in one one and the entire ward staff was drunk!) Disabilities are minimally treated and traditionally the disabled are social pariahs to be avoided and ridiculed. I know this because I’ve lived in Russia off and on for 20 years. The streets are full of drunks, junkies, maimed Afghan vets, amputees, and old people begging. It’s not uncommon to run across a dead body in a doorway or a metro station.

    Unless Kolya’s parents were of the Moscow new rich class, Kolya would never have had a chance for anything but instiutionalization, and early death. Nobody knows for sure, but the parents seemed to have believed that the only chance for him was to be adopted in the West.

    Relinquishment is quite a different procedure than in the US, and adoption is not popular since “orphans” are considered bad business– somebody else’s problem.

    Kolya is the only Russian-US case that I know of where the parents voluntarily relinquished, if newspaper reports are true. The baby houses and orphanages are full of the children of drunks, junkies and abusers taken away from their parents by the state, and the abandoned. Some kids however, are placed there by parents who can’t afford to keep them at the moment, but do not plan to terminate their right.

    I think Kolya’s parents thought they were doing the best under bad circumstances. They probably terminated their rights only when he had a chance to be adopted by a Russian national in the US who had experience with DS children since he had oe of his own. It would be interesting to know how the termination came about. Was it before the Emelyantsevs came on the scene or after. And what role did the orphanage play in the termination?

    Of course, I’m only going by press accounts. There is a lot more to this story, but since it comes out of Utah we will probably never know. I suspect there’s a lot of blame to spread around.
